# Witness-Evidence Matrix

This matrix rates the **support for each factual proposition**. It does not assign a probability that a person is “lying” or “guilty.” A person can accurately report what they remember while the underlying fact is still weakly supported.

### Rating scale

| Rating | Meaning |
| ------------- | -------------------------------------------------------------------------------------------------- |
| **VERY HIGH** | Objective record or exceptionally strong independent corroboration |
| **HIGH** | Strong firsthand basis plus meaningful corroboration |
| **MEDIUM** | Plausible firsthand account, but important details remain unverified |
| **LOW** | Hearsay, unclear opportunity to observe, source-chain problem, or substantial conflicting evidence |
| **VERY LOW** | Unauthenticated/anonymous, materially contradicted by stronger evidence, or unsupported inference |
| **UNSCORED** | Opinion, belief, denial, emotion, character assessment, etc. |

The objective backbone is especially important: the tracked Triton arrived at Horn Island at **11:14 a.m.**, remained in a GPS pattern characterized as stationary through 4:30, began sustained northbound movement at **4:31**, moved slowly through 5:24, and resumed normal 30–35-knot operation at **5:25**. A reproduced phone record now places the Sea Tow call at **4:48**, not before 4:31. ([Nolan Wells Evidence File][1])

| They arrived around **10:30 a.m.** | Memory | **VERY LOW for exact time** | Objective GPS says the Triton arrived **11:14 a.m.** This establishes that Warren's remembered clock times can be substantially off; it does **not** establish deception. ([Nolan Wells Evidence File][2]) |
| Horn Island was extremely crowded | Personal observation | **HIGH broadly / LOW-MEDIUM for exact thousands** | Crowded Fourth-of-July conditions are credible; “2,000–4,000” is an estimate, not a count. ([Nolan Wells Evidence File][2]) |
| Nolan seemed fine and was socializing/drinking | Personal observation | **MEDIUM-HIGH** | Warren could assess appearance and behavior, not Nolan's internal condition or precise intoxication. |
| Warren ran to Carter's fight | Personal action | **HIGH** | Fits Tracestin's separate account that Carter became involved in the altercation sequence. ([Nolan Wells Evidence File][3]) |
| Warren did not see Nolan involved in that fight | Personal observation | **HIGH for “I didn't see him”** | Important distinction: it supports Warren not seeing Nolan there; it cannot establish Nolan's absolute location throughout the entire incident. ([Nolan Wells Evidence File][3]) |
| Triton had substantial water, bilge trouble and trim/electrical trouble | Firsthand + objective evidence | **VERY HIGH core claim** | The released Sea Tow call, GPS behavior, Bart's account and later interviews all independently support a genuine vessel emergency. ([Subtxt Press][4]) |
| Warren personally last laid eyes on Nolan at about **3:00 p.m.**, with Katie | Personal observation | **MEDIUM-HIGH** | Strong firsthand proposition; exact 3:00 is still an estimated time rather than a device timestamp. Warren explicitly distinguishes it as his personal last visual. ([Nolan Wells Evidence File][3]) |
| During departure, somebody—identified elsewhere as Wyatt—repeatedly called Nolan aboard | Warren's claimed auditory/scene knowledge | **MEDIUM** | Jax later gives substantially the same event. But there is no contemporaneous recording of the exchange or complete independent listener list. ([Nolan Wells Evidence File][3]) |
| Nolan responded that he was staying and would ride back with somebody else | Warren's narration; precise sensory basis unresolved | **MEDIUM** | This is the central disputed proposition. It is supported by Jax's later account and the early police summary of “several friends,” but contradicted in direction by Katie-derived accounts and lacks an identified alternate ride. ([Nolan Wells Evidence File][3]) |
| At least five/everyone nearby heard Nolan refuse | Warren's observation/inference | **LOW-MEDIUM** | Public evidence still does not name and separately authenticate the supposed listener set. “Numerous witnesses” therefore cannot yet be treated as numerous **independent** witnesses. ([Nolan Wells Evidence File][3]) |
| Nolan affirmatively “decided” to stay with Katie | Warren's interpretation of the exchange | **LOW-MEDIUM** | Even accepting “I'm staying,” “staying **with Katie**” is a stronger proposition. Katie-related evidence says she expected Nolan to leave with his friends. ([Nolan Wells Evidence File][5]) |
| Katie later messaged one of Warren's friends and corroborated Nolan deciding not to board | Message described by Warren | **LOW** | Native message/thread has not been publicly produced in a form resolving its meaning; Katie-derived accounts through Gracie, Rhiannon and Cox point toward her believing Nolan would leave. ([Nolan Wells Evidence File][3]) |
| Riding out with one boat and returning on another is commonplace | Personal boating experience | **HIGH as general practice** | Entirely plausible. It provides context, not proof Nolan had a particular ride arranged. |
| Nolan actually **had** an alternate ride | Inference from alleged words | **VERY LOW presently** | No publicly identified boat, captain, passenger, agreement, or completed ride. Police were still checking mainland launches the next day for whether such a ride existed. ([Nolan Wells Evidence File][6]) |
| They departed around 4:30 | Personal observation + GPS | **VERY HIGH** | Sustained GPS movement begins at **4:31**. ([Nolan Wells Evidence File][1]) |
| Bart initially assisted/towed them | Personal observation + independent evidence | **VERY HIGH** | Bart's statement, Sea Tow call and slow GPS phase all support private assistance. ([Scribd][7]) |
| Plug was pulled and boat eventually planed so water could drain | Personal observation + mechanical/GPS evidence | **HIGH core / MEDIUM exact sequence** | GPS strongly supports eventual recovery at 5:25. The exact minute-by-minute sequence in later narration should not substitute for raw GPS points. ([Nolan Wells Evidence File][3]) |
| Later that evening Warren began asking “Where's Nolan?” | Personal recollection | **HIGH** | Fits his subsequent calls/texts and Tracestin's independent account. ([Nolan Wells Evidence File][3]) |
| Warren texted Jayvon and others asking whether Nolan rode back with them | Personal communication | **MEDIUM-HIGH** | Fits the overall late-night search sequence; native text thread would elevate it to very high. ([Nolan Wells Evidence File][3]) |
| At that stage Warren did not actually know where Nolan was | Personal state + communications | **VERY HIGH** | Warren's own search behavior and Tracestin's recollection that Warren said they couldn't reach Nolan and didn't know where he was strongly converge. ### Warren overall

The evidence does **not** show that “everything Warren says is false.” In fact, many mechanical and logistical claims are strongly corroborated.

The narrower and more consequential unresolved issue is:

**The strength of his language about Nolan's deliberate decision exceeds what the public record currently establishes about Warren's own sensory source.**

His strongest statement is essentially:

**“I personally last saw Nolan around 3.”**

His most consequential later assertion is:

**Nolan affirmatively refused to board and chose another ride.**

Those can coexist if Warren **heard** the later exchange without seeing Nolan. But the public interview never satisfactorily isolates:

**Where exactly was Warren? What did Warren personally hear? Which words did he hear himself? Which came from Wyatt/Jax afterward?**

That is the unresolved issue in Warren's account; it is not proof that he lied.

Jax provides the most consequential **publicly claimed direct ear-witness** account of the refusal.

### Jax overall

The evidentiary significance of his account lies in the **most falsifiable firsthand claim**:

> Jax says he was there and personally heard the critical Nolan–Wyatt exchange.

That makes the original **separate Jax police interview** exceptionally valuable.

If Jax told investigators essentially the same thing independently at the first opportunity, that materially strengthens the refusal account.

If his original account says something different—particularly *“Wyatt told me afterward”*—that would materially weaken the later firsthand presentation.

# 3. Wyatt Pyron

Wyatt is potentially the **best firsthand witness**, but little complete direct public testimony is available.

### Critical statements **attributed to Wyatt**, but not presently established through Wyatt's own complete public account

The following attributed statements are material:

* Wyatt allegedly repeatedly told Nolan to board.
* Wyatt allegedly was the most forceful person urging Nolan to leave.
* Wyatt allegedly personally heard Nolan refuse.
* Wyatt allegedly heard Nolan say he had another ride.
* Wyatt would know exactly where Nolan stood when this happened.
* Wyatt would know who was close enough to hear it.
* Wyatt would know whether Nolan identified a person or boat.
* Wyatt would know whether Nolan ever asked for his phone.

Those currently come primarily through **Jax/Warren**, not a full direct public Wyatt narrative. ([Frontpage Detectives][12])

### Wyatt overall

**Highest-value missing direct witness account in the case.**

That does **not** make him the strongest suspect.

It means that if the alleged refusal happened as described, Wyatt should possess perhaps the best firsthand evidence of it.

# 4. Morgan Seymour

Morgan should not be treated as equivalent to Jax for the final-refusal claim.

| Morgan had already departed before the final boat-emergency/refusal sequence | Group interview | **HIGH-MEDIUM** | The later discussion explicitly places Morgan leaving roughly five minutes before the final two boats. ([Buzzsprout][15]) |
| Therefore Nolan deliberately refused the final boat | Secondhand/group knowledge for Morgan | **LOW as Morgan-firsthand evidence** | Morgan cannot independently corroborate words occurring after he left. |

| Phone not improperly accessed | Personal denial | **UNSCORED for own conduct** | Universal assertion requires forensics. |

### Morgan overall

For the crucial question **“Did Nolan personally refuse the last ride?” Morgan's evidentiary weight is low.**

His participation in a joint interview should not cause his presence to be counted as a third firsthand witness.

# 5. Tracestin Shepherd

Tracestin is especially useful because his chronology is substantially different from Warren/Jax's and he left separately.

### Tracestin overall

The most important finding is:

**Tracestin is NOT an independent firsthand witness to the alleged final refusal based on his detailed later account.**

His own chronology says his last Nolan encounter occurred **before the fight**, then his uncle held him on the boat and they left.

His late-night statement that Nolan had been “with that girl” was explicitly **“last time I knew.”**

That statement does not support the broader proposition:

**“Tracestin confirms Nolan stayed behind with Katie.”**

It does not.

### Jayvon overall

His account is useful precisely because he **doesn't claim to know everything**.

His most important evidence is the **15–20 minute observation gap around the fight/departure period**.

### Katie overall

Katie is arguably the **most important independent witness to the refusal dispute**, not because she is implicated in wrongdoing, but because her actual first-person recorded statement could resolve:

**What did she hear?
Where was she standing?
Did she hear Nolan say “I'm staying”?
Did she hear “another ride”?
Did she see Nolan walk toward or away from the boats?
Why did she believe he was leaving with them?**

Public evidence presently supports **her believing Nolan was leaving** more strongly than it supports **her witnessing Nolan choose to stay with her**. ([Nolan Wells Evidence File][13])

| Bart personally witnessed Nolan refusing the ride | **No complete public Bart statement establishes this** | **UNSUPPORTED publicly** | |

### Bart overall

The boat-assistance portion of Bart's account is among the **most strongly corroborated witness narratives in this case**.

The public record currently provides no evidentiary basis for treating Bart as a firsthand witness to Nolan's alleged final decision.

| Statement | Support | Assessment |

| Christine/sister saw little or no relevant saved Snapchat content from July 4 | **HIGH that this was their observation** | Does **not** establish deletion. Snapchat preservation behavior and forensic status matter. |
| Someone in the friend group deleted Nolan's content | **VERY LOW currently** | Public forensics do not establish this. |

# 10. Elmore Wonsley

| Statement | Support | Assessment |
| --------------------------------------------------------------------------------------------------------- | ----------------------------: | ----------------------------------------------------------------------------------------------------- |
| Nolan was taught to leave and return with the same group | **HIGH as parental practice** | Does not prove he followed that rule July 4. ([Cockatoo][21]) |
| Elmore does not believe Nolan voluntarily stayed | **UNSCORED** | Opinion based on character. |
| If he had been present, he would have made Nolan board/contact parents | **UNSCORED** | Hypothetical. |
| During later key retrieval, somebody he believed was Jax initially said they couldn't locate Nolan's keys | **MEDIUM** | Firsthand event, but Elmore himself was uncertain about exact identity. |
| After someone said the keys were on/near an Xbox, they were produced | **MEDIUM** | Useful sequence, but not proof of deliberate concealment. |
| Elmore concludes he was lied to about the keys | **LOW-MEDIUM as inference** | The sequence can support suspicion, but alternative explanations remain. |
| Elmore/coach searched Horn Island the next morning | **HIGH** | Consistent with official search chronology. ([https://www.live5news.com][22]) |
| They would have necessarily seen Nolan's body if it were there then | **LOW** | Visibility, location, tides/current, depth, decomposition and search coverage prevent that certainty. |

# 11. Gracie McCormack

Gracie is **not an island eyewitness to Nolan's final interaction**, as far as the public record establishes. She is important because she relays Katie's account.

| Statement | Support |
| ---------------------------------------------------------------------- | --------------: |
| Katie had been talking with Nolan | **HIGH-MEDIUM** |
| Katie believed Nolan was getting ready to board the boat he arrived on | **MEDIUM** |
| Katie believed the friends calling him aboard would not leave him | **MEDIUM** |
| Katie left with her own group/family rather than Nolan | **MEDIUM-HIGH** |
| Katie cooperated with investigators/family | **MEDIUM** |

([Hindustan Times][23])

Gracie's account is **secondary evidence**, but importantly it points in a different direction than Warren's characterization of Katie as a witness to the refusal.

---

# 12. Rhiannon Waltman

The compiled public replies attributed to Rhiannon describe Katie as:

* hearing friends call Nolan aboard,
* saying goodbye,
* walking toward her separate boat,
* assuming Nolan would leave with his friends,
* and **not witnessing a refusal or alternate-ride arrangement**.

That package is rated **LOW-MEDIUM** because it provides useful contextual corroboration but remains one step removed from a native Katie interview or message set. ([Nolan Wells Evidence File][24])

# 13. Anna C. Moore

| Statement | Support |
| ----------------------------------------------------------------------- | ----------------: |
| She recorded the circulated clip | **HIGH** |
| She never claimed Nolan was depicted | **HIGH** |
| She never claimed the argument in the clip was Nolan's argument | **HIGH** |
| She reviewed/shared the video after Nolan disappeared in case it helped | **HIGH-MEDIUM** |
| Her clip proves Nolan's location at 4:01 | **VERY LOW** |
| Native 4:01 timestamp has been authenticated | **LOW presently** |

The archive specifically notes that native metadata has not been obtained. ([Nolan Wells Evidence File][1])

---

# 14. Ivy Elizabeth

Ivy says she and her husband appear in the relevant boat scene and describes the yelling/video as following an altercation. She says a background person merely **resembled** Nolan and expressly does not claim certainty.

That makes her overall account **MEDIUM**, while an identification of the background figure as Nolan is **LOW/VERY LOW**.

Her caution is actually a credibility-positive feature: she doesn't pretend to know what she doesn't know. ([Nolan Wells Evidence File][1])

---

# 15. Carter Hudson

No complete direct public interview with Carter has been recovered.

What is independently said **about Carter**:

| Claim | Support |
| ---------------------------------------------------------------------- | ------------------------------------: |
| Carter became involved in an altercation | **MEDIUM-HIGH** |
| Warren learned Carter had fought and went over there | **HIGH for Warren's experience** |
| Tracestin says Carter subsequently confronted the man Tracestin fought | **MEDIUM-HIGH** |
| Nolan participated in Carter's fight | **LOW/unsupported by these accounts** |
| Carter has knowledge of Nolan's alleged final refusal | **UNKNOWN** |

Warren and Tracestin's accounts partially converge regarding Carter's involvement in the fight sequence. ([Nolan Wells Evidence File][3])

This makes Carter potentially useful for **fight chronology**, not presently evidence of involvement in Nolan's death.

# 16. Lucas Aviz

A derivative screenshot attributes to Lucas an account that he last spoke with Nolan around **2:00–2:30**, when Nolan said he had to leave, and that Lucas later saw Nolan get onto a white center-console boat.

Because the original post/native statement hasn't been recovered:

**Rating: LOW.**

But it is a potentially valuable lead because it is framed as firsthand and describes a physical movement. ([Nolan Wells Evidence File][1])

---

# 17. Stephen Ray

A screenshot attributes to him the tentative belief that he **may** have seen Nolan later on the east end/sand dunes.

He himself reportedly uses uncertain language.

**Rating: VERY LOW–LOW.**

It should be investigated, not used as established evidence. ([Nolan Wells Evidence File][1])

---

# 18. Robbie Robertson

A direct public post reportedly says:

* his photograph was taken at the west end at **7:17 PM**,
* only four boats remained around that area,
* three departed shortly afterward,
* his boat remained until approximately 9.

The support for **his boat/group's presence and local boat-count observation** is **MEDIUM-HIGH**, assuming the preserved direct post remains authenticated.

It does **not** establish where Nolan was. ([Nolan Wells Evidence File][1])

This witness could nevertheless help answer the extremely important question:

**Who actually remained at the west tip after the main crowd dispersed?**

---

# 19. Katelynn Brochard

Public material attributed to her says:

* Nolan introduced himself to her husband,
* her group was next to Nolan's broader group,
* Nolan was not visible when her group departed around 7:30,
* an ambiguous “they” departed around 5.

Assessment:

**Nolan introduced himself / local interaction: MEDIUM.**
**She personally did not see Nolan at 7:30: MEDIUM.**
**Therefore Nolan wasn't anywhere on Horn Island at 7:30: VERY LOW.**

A negative sighting is local, not island-wide. ([Nolan Wells Evidence File][25])

---

# 20. Faith Lauren lead

Screenshots attributed to a “faithlaurennx” account describe:

* a dispute involving Nolan's phone,
* an argument continuing toward shore,
* a physical confrontation involving several people,
* a woman asking for it to stop,
* Faith/her family leaving as things worsened,
* and a stated intention to provide footage/information to police.

This material could be significant **if authenticated**, but presently:

**Rating: LOW.**

The archive has screenshots and attributed material rather than native footage, a direct recorded interview, confirmed identity and position, or proof of law-enforcement receipt.

The archive itself correctly treats the statement as a claim requiring verification. ([Nolan Wells Evidence File][26])

This lead warrants focused investigation but should **not be stated publicly as fact** at present.

---

# 21. Erick Alcantara / “Johnny”

The available public material does **not** contain a sufficiently authenticated direct Erick account establishing Nolan's final location or ride arrangement.

Therefore:

**Any proposition such as “Erick arranged Nolan a ride,” “Johnny was Nolan's ride,” or “Erick knew who took Nolan home” currently rates VERY LOW/UNPROVEN unless the native message/interview is produced.**

Absence of a public interview or social-media behavior cannot itself establish wrongdoing.

---

# 22. Ashlee Cole

Cole was **not an island eyewitness**.

Her early public statement reportedly contains several propositions:

| Proposition | Support |
| ---------------------------------------------------------------- | -------------------------------------: |
| Group's boat developed bilge trouble | **VERY HIGH** |
| Group left around 4:30 | **VERY HIGH** |
| Warren's last sighting around 3 | **MEDIUM-HIGH** |
| Nolan deliberately decided to stay and return with another group | **LOW as Cole's independent evidence** |
| Friends were cooperating with investigators | **MEDIUM** |

The important evidentiary rule is:

**Cole repeating Warren/the group's account does not create another independent witness.**

# 23. Tyler Cox

Cox wasn't on Horn Island. His importance is access to his clients and their communications.

| Cox statement | Support |
| --------------------------------------------------------------------------------- | ------------------------------------------------------------------------------: |
| Clients began asking people where Nolan was before calling Christine | **MEDIUM-HIGH** |
| They obtained Katie's contact through mutual friends | **MEDIUM** |
| They contacted Katie before Christine | **MEDIUM** |
| Katie responded essentially, “We thought he was leaving with y'all” | **MEDIUM** |
| His clients didn't previously know Katie | **MEDIUM** pending contact records |
| He separately screened/interviewed clients and believed their accounts consistent | **MEDIUM that he performed this process / does not independently prove events** |

The Katie sequence is particularly important because it is an **admission from their own attorney that Katie's response did not confirm she had Nolan**. ([PodScripts][8])

# Cross-witness findings

## A. The boat emergency is overwhelmingly supported

The available evidence does not support treating the bilge emergency as fabricated.

Wyatt's contemporaneous Sea Tow call + Bart + Warren/Jax + official GPS behavior give this **VERY HIGH** support. ([Subtxt Press][4])

That does not answer what happened to Nolan, but it provides a fixed part of the evidentiary record.

---

## B. The **refusal**, by contrast, is nowhere near that level

The public evidence currently supports the following comparison:

| Person | Independent firsthand support for refusal? |
| ------------- | ------------------------------------------------------------------------------------------------------ |
| **Jax** | **YES — claimed directly** |
| **Wyatt** | Presumably central, but complete direct public account unavailable |
| **Warren** | Narrates it, but sensory source needs clarification because he separately places his last visual at ~3 |
| **Morgan** | **NO — had already left** |
| **Tracestin** | **NO — last Nolan interaction before fight and then left** |
| **Jayvon** | **NO — observation gap during fight period** |
| **Katie** | Publicly derived account actually points toward Nolan leaving |
| **Bart** | No public direct final-refusal account recovered |
| **Carter** | No direct public refusal account recovered |

This record does not support the broader assertion:

**“Everybody saw Nolan choose to stay.”**

The public record does not establish that everyone witnessed such a decision.

---

# C. “Nolan had another ride” has two completely different evidentiary meanings

### Proposition 1

**Nolan said something about another ride.**

Current support: **MEDIUM.**

Primarily Jax/Warren + early police summary.

### Proposition 2

**An actual alternate ride existed.**

Current support: **VERY LOW.**

No publicly identified:

* boat,
* captain,
* passenger,
* agreement,
* text,
* phone call,
* physical transfer,
* mainland arrival.

And investigators were still checking launches the next day to see whether he may have gotten such a ride. ([Nolan Wells Evidence File][6])

That distinction is material.

---

# D. Katie-derived evidence complicates the simplified narrative

Warren later characterizes Katie as effectively corroborating the refusal.

However:

**Gracie → Katie believed Nolan was getting on his original boat.**

**Rhiannon-derived account → Katie said goodbye and believed he would leave with friends.**

**Cox → Katie said, “We thought he was leaving with y'all.”**

([Nolan Wells Evidence File][13])

Those three are not totally independent because they ultimately derive from Katie, but they are remarkably consistent **in direction**.

Current rating:

**“Katie personally witnessed Nolan decide to remain with her” → LOW.**

That is one of the most important corrections to the public narrative.

---

# E. Warren's 3:00 PM statement is material but does not prove deception

Objective GPS establishes departure around 4:31.

Warren later says **his own personal last visual** was around 3.

A displayed text reportedly has him answering **3 PM** when Christine asks when “you guys” last saw Nolan.

Meanwhile other accounts potentially place Nolan later.

This supports a credible hypothesis:

**Warren's personal ~3 PM sighting may have become generalized into the group's “last seen” time.**

But that is different from proving:

**Warren knowingly told authorities the boat left at 3.**

The public evidence still doesn't establish who transformed “last saw him around 3” into the later dispatch report that his arrival boat had left about 3.

That source-chain must be solved.

---

# F. The late-night sequence is one of the most valuable parts of the entire case

The most defensible reconstruction is:

**Warren doesn't know Nolan's whereabouts → asks people if Nolan rode home with them → group reportedly contacts Katie → Katie reportedly says she thought Nolan was leaving with them → Warren calls Christine → Coast Guard is contacted → “chose to remain with a female / probably rode another vessel” becomes the early police working premise.**

([Nolan Wells Evidence File][3])

The central unresolved question is:

### Exactly where did certainty enter that chain?

Because the contemporaneous search behavior sounds like:

**“We don't know where Nolan is.”**

The resulting official premise sounds much stronger:

**“Nolan chose to remain and likely rode another vessel.”**

Those propositions are not mutually exclusive, but **the evidentiary bridge between them remains unidentified.**

---

# Statements under the greatest unresolved evidentiary pressure

This comparison does not assess guilt. It identifies **which material accounts face the greatest unresolved evidentiary pressure**.

| Person | Main issue | Current assessment |
| ------------- | ---------------------------------------------------------------------------- | -------------------------------------------------------- |
| **Jax** | Makes clearest direct claim to hearing final refusal | **Most directly testable** |
| **Wyatt** | Allegedly participated in the exchange but full direct public account absent | **Most important missing account** |
| **Warren** | Certainty/source chain + 3 PM + late-night narrative transmission | **Largest knowledge-source problem** |
| **Katie** | Account potentially contradicts stay-with-Katie shorthand | **Most important independent resolving witness** |
| **Tracestin** | Earlier departure/last contact helps reconstruct sequence | **Strong timeline anchor, not refusal witness** |
| **Jayvon** | Observation gap around fight/departure | **Strong independent chronology witness** |
| **Morgan** | Left before crucial exchange | **Weak refusal witness** |
| **Bart** | Excellent vessel-emergency witness | **Strong mechanical witness, weak Nolan-intent witness** |

# Probable-cause assessment

The statement-by-statement comparison does **not** place the public evidence close to probable cause for homicide against Warren, Jax, Wyatt, Morgan, Bart, Tracestin, or anyone else.

The strongest-supported propositions in the record concern **events**, not criminal culpability:

**VERY HIGH:** Triton emergency.
**VERY HIGH:** ~4:31 departure movement.
**VERY HIGH:** prolonged slow movement then 5:25 recovery.
**VERY HIGH:** Nolan's phone returned to mainland without Nolan.
**VERY HIGH:** by late evening friends did not know Nolan's actual whereabouts.
**HIGH:** Warren's personal last visual was around 3.
**MEDIUM:** Nolan verbally refused the ride.
**VERY LOW:** a specific alternate ride actually existed.
**UNKNOWN:** what caused Nolan's death.
**UNKNOWN:** who, if anyone, committed a criminal act against him.

The independent autopsy remained undetermined, the official autopsy remains unreleased publicly, and as of early September the investigation still had not publicly established a homicide or identified a perpetrator. ([New York Magazine][27])

Progress toward a probable-cause assessment requires more than additional contradictions. It requires records that establish knowledge and intent.

The five highest-priority records are:

**#1 — Wyatt's original JCSO interview.**
**#2 — Jax's original JCSO interview.**
**#3 — Warren's original JCSO interview.**
**#4 — Katie's complete recorded law-enforcement statement + native Katie/group messages.**
**#5 — Complete native phone/device records for Nolan, Wyatt, Warren, Jax and the relevant group during approximately 3 PM–midnight July 4.**

If those records show that **Jax, Wyatt and Warren independently gave the same specific refusal account before communicating about it**, the refusal narrative becomes much stronger.

If the records instead show that **the initial accounts were uncertain or secondhand, and the specific “Nolan chose another ride” account crystallized only later**, that would be one of the most consequential discoveries in the case.

If a native communication establishes that a particular person **knew Katie had contradicted the “staying with Katie” explanation and nevertheless subsequently gave investigators that explanation as firsthand fact**, the record would then contain evidence relevant to **knowledge/mens rea**, rather than merely inconsistency.

That is where the investigation should now concentrate.
